Empowering Voices Terms and Conditions

Terms

  1. “Empowering Voices”, “we” and “our” means EMPOWERING VOICES, charity number 1207800 Charity Commission for England and Wales, a charitable incorporated organisation with its registered office at 54 West End Road, Frampton, Boston PE20 1BT.

  2. “Course” means an Empowering Voices course designed and run by Empowering Voices.

  3. “Support” means support provided by Empowering Voices.

  4. You must agree to these Terms and Conditions before attending a course or using our Support.

  5. We may change these Terms and Conditions at any time without giving you notice.

 

General

  1. This is not a cure for stammering. To the best of our knowledge, there isn’t one, but it can help many people say what they want, how they want, when they want and ultimately without fear.

  2. The Empowering Voices speech technique requires commitment and dedication from course participants. It is a “the more you put in, the more you get out” proposition.

  3.  Although everyone at Empowering Voices will try to help you tirelessly, we cannot guarantee that you will achieve what you want to with your speech.

Code of Conduct

  1. Everyone is expected to act respectfully.

  2. Everyone has the right to be treated courteously and compassionately.

  3. Everyone must comply with Empowering Voices procedures and policies.

  4. Everyone helping you learn the Empowering Voices technique is a volunteer. Please give 100% effort during the course to reflect our mentors' dedication to help us.

  5. Punctuality and attendance are crucial to the success of the Empowering Voices course for you and the other attendees.

a. Always try to arrive earlier than the given start time; we always want to start on schedule out of respect for the other course participants and ensure everything can be covered.

b. We have many breaks; please return to the training room on time.

c. You need to attend EVERY session, including the evening meal, to get the full benefit from the Empowering Voices course.

 

Booking a course

  1. If you are interested in enrolling in a course and we haven’t already reached out to you, please get in touch with Empowering Voices at www.empoweringvoices.co.uk . Empowering Voices will then contact you with details of any availability.
    If you have attended a course before, you will generally not be charged for attending any future courses. The exception is for course attendees who have attended a course previously and have allowed their technique to lapse to a point where they need to go through the course again as a new candidate.
    If you have not attended a course before but have attended another costal breathing speech course, an assessment will be made to determine whether you will qualify for an exemption to the course fee or whether a first-course fee of £250.00 will apply to you. The outcome of the assessment, together with the details of any course fee payable upon booking and payment methods, will be confirmed with you before you place your booking.

  2. Empowering Voices will confirm all successful course bookings by email. If you have not received confirmation of your course booking, it is your responsibility to contact Empowering Voices by emailing hello@empoweringvoices.co.uk to arrange for the booking confirmation to be resent.

Cancellations, Rescheduling and Substitution

  1. We may cancel or reschedule a course at any time.

  2. In the unlikely event that we cancel a course:

a. we will inform you of this as soon as possible.

b. will give you the option of attending the next available course.

c. If you wish to claim a refund of the course fee paid by you and received by Empowering Voices, please notify us in writing within 28 days of us sending you notification of the course cancellation.

d. If we cancel a course and have not received a written request from you for a refund within 60 days, Empowering Voices will treat the course fee received as a donation to the work of Empowering Voices.

e. We will not offer compensation for hotel bookings, travel expenses, or any other out-of-pocket expenses related to our cancellation of the course.

   3. If you can no longer attend a course you have booked, please email hello@empoweringvoices.co.uk .

   4. Places on courses are limited, and any requests to reschedule will be accommodated subject to place availability on future        courses.

   5. If you:

a. cancel your course attendance within 14 days (the cooling off period) of making the booking (starting on the day after the day on which the place on the Course was booked); or

b. cancel your course attendance any time up to 14 days before the course start date,

Empowering Voices will refund your course booking fee, if any, received by Empowering Voices for that Course.

   6. If you cancel your course by giving less than 10 working days’ notice before the course start date, Empowering Voices will       offer Your place to any person on a waiting list, and if they can take your place, your £250 will be refunded. If we can’t find   someone to take your place on the course the £250 fee will not be refunded.

Failure to comply with any policies or procedures

  1. Our courses are safe for people who stammer; we are determined to maintain the best environment for stammerers to improve their speaking lives.

  2. We are committed to safeguarding our course participants and volunteers.

  3. If a course participant or volunteer fails to comply with Empowering Voices Terms and Conditions, Policies and Procedures, you may be asked to leave the course.

  4. If you are asked to leave, your course fee will not be refunded, and you will not be entitled to any compensation, such as incurred costs.

  5. If you disagree with a decision to ask you to leave the course, you may file a complaint for consideration by Empowering Voices Management and Trustees.

Limitation of Liability

  1. Except in respect of death or personal injury caused by the negligence of Empowering Voices, Empowering Voices shall not be liable by reason of any representation (unless fraudulent) or implied warranty, condition or other term, or any duty at common law or under these Terms and Conditions, for any loss of profit or any indirect special or consequential loss, costs, expenses or other claims for compensation.

  2. Empowering Voices entire liability to you under or in connection with the provision of a course and Support shall not exceed the sum of the price paid by you for the course and the Support. Nothing in this paragraph is intended to exclude any liability on the part of Empowering Voices for fraud.

  3. Empowering Voices will not be in breach of its obligations under these terms and conditions nor liable for any loss or damage which may be suffered by another party due to any cause beyond its reasonable control.

  4. This includes, but is not limited, to any act of God, strike, trade dispute, act of terrorism, act or omission of government or regulatory bodies.

Data Protection

  1. You agree that the information provided to Empowering Voices in connection with the course booking may be used by Empowering Voices in accordance with the prevailing data protection legislation.

  2. Empowering Voices will use the information provided by you to manage the course and your involvement in it. Empowering Voices will keep you up to date with Empowering Voices activities or provide any other information in accordance with your stated preferences.

General

  1. If any provisions of these terms and conditions are held to be invalid or unenforceable, this will not affect the validity or enforceability of the remaining provisions.

  2. These terms and conditions constitute the entire agreement between you and Empowering Voices supersede all other communications and proposals, whether electronic or written, between you and Empowering Voices.

  3. Any failure of Empowering Voices to exercise or enforce any of its rights under these terms and conditions shall not be deemed to be a waiver of any such rights.

Equality, Diversity & Inclusion

  1. Empowering Voices has an Equality, Diversity & Inclusion Policy. To enable Empowering Voices to ensure you are treated fairly, and your requirements are fully met, you must tell Empowering Voices in advance of any special arrangements you need to make to enable you to participate fully in the course.

  2. Empowering Voices provides no specialist equipment or personnel such as personal carers. However, these can be sourced at your own cost. Where personal carers are required, they may attend the course to support you.

Jurisdiction

The terms and conditions are governed by the laws of England and Wales. Any disputes arising from or relating to the website, any transactions made on the website and/or these terms and conditions will be subject to the exclusive jurisdiction of the English courts.

Privacy

  1. Some people who attend our courses or use our support network may have done so without informing others.

  2. Photographs must not be taken in a group setting without the knowledge and agreement of those involved.

  3. contact details for any Empowering Voices participant must not be shared outside of the charity.

  4. Access to the Empowering Voices website “Members Area” must only be used by the person granted access.

Complaint Procedure

If you are unhappy with your treatment, please email the full details to hello@empoweringvoices.co.uk. We will endeavour to acknowledge your complaint within 48 hours and let you know our findings within 4 weeks.
